Can I be made bankrupt whilst in an Individual Voluntary Arrangement?

Published in Debt Advice Features on Sunday, December 31 2006 by Ideal Debt Solutions

Yes, but only if you break the terms of the IVA.

This usually means if you have missed three consecutive payments into the IVA, then the creditors or your Insolvency Practitioner can petition for your bankruptcy. If you IVA failed because you have acted fraudulently for example, you may still be made bankrupt or it may be deemed better if a different solution to bankruptcy is reached.
